They hail from the land of the free, the home of the brave, a place where it is said anyone can prosper regardless of colour, creed or religion. But dozens of Americans have tried in recent years to gain asylum in the UK by claiming they were persecuted in their homeland, according to figures released to the Guardian under the Freedom of Information Act.

Home Office statistics show that between 2004 and 2008, 45 Americans submitted asylum applications to the UK Border Agency claiming they had fled the US and were unable to go back because they had a well-founded fear of persecution. Fifteen Canadians also applied. All 60 were turned down.

A US government source said the American applications were most likely submitted by self-declared “political refugees” claiming they faced discrimination under the last administration. The applications from the US peaked in 2008, the final year of George Bush’s presidency, when 15 Americans submitted asylum claims.

Between 2004 and 2008 there were 132,640 asylum claims made in the UK, according to government statistics.

The Home Office refused to reveal the rationale behind the claims or why they were refused, saying a manual search of the records would be required, exceeding the time limit for Freedom of Information requests.

But on various online forums, people claiming to be American refugees have outlined their cases. One Texan hoping to be allowed sanctuary in Scotland claimed he had been “persecuted as a political dissident against US government war-mongering”.

Liza Schuster, an asylum expert from the department of sociology at City University, said: “I don’t know the details of those cases, but assume the US citizens are deserting before being sent to somewhere like Afghanistan. With the Canadians I’m really not sure. It is, as is clear from the numbers, pretty unusual – if only because it is relatively easy for those people to leave their countries and settle elsewhere. Why not just apply for a work visa and renew and then apply for leave to remain?

“As someone who would not find admission to European countries too difficult, it would only make sense to claim asylum if you feared extradition back to Canada or the US, or if there was some reason you might be refused entry. It is interesting – I’d be curious to know more – not least because in spite of what the law books say, granting asylum is a criticism of the originating state.”

According to the Home Office figures, most of the US and Canadian applicants were aged between 18 and 59, though a small number of American asylum seekers were over 60.

The Refugee Council, the largest organisation in the UK working with asylum seekers and refugees, said it had helped 18 American and two Canadian asylum seekers between 2004 and 2008. The adults ranged in age from 29 to 59 with a mean age of 44. The Americans had nine dependent children aged under 16.

“In this time this group of clients attended 40 advice sessions and mainly came to see us regarding their entitlement to UKBA asylum support, and issues associated with destitution,” said a spokeswoman.

Donna Covey, the chief executive of the Refugee Council, said: “No country is safe for every person all of the time. Those with a genuine need for protection, whatever country they are from, should have the right to claim asylum in a place of safety.”

A small number of Americans have successfully claimed asylum abroad over the past few decades. In 1997 the Netherlands granted asylum to Holly Ann Collins, together with her three children, when they claimed to be fleeing domestic abuse. The family had spent three years living in four different Dutch refugee camps before their application was approved.

In June 2008 Texan mother Chere Tomayko and her two daughters were granted asylum in Costa Rica, also on the grounds of abuse.

After America went to war in Iraq in 2003 a number of US soldiers deserted and crossed the border to Canada, where they tried to claim asylum.

For a number of years Private Bethany Smith has been fighting to stay in Canada, claiming she was persecuted in the army because she is a lesbian.

Smith, who now goes by the name Skylar James, told Canadian authorities she was repeatedly harassed and threatened with death, then denied an honourable discharge because her superiors wanted to send her to Afghanistan. In November a senior judge ordered Canada’s immigration and refugee board to look again at her case.

In November 2004 I was at in an British Airways lounge at JFK airport and while waiting to board a flight to Manchester, UK I was watching John Kerry give his concession speech. Disappointed with the outcome, I called my partner in the UK and jokingly said ‘ Can I apply for political asylum while I’m there?’
Apparently I wasn’t the only person with the same idea.

According to Freedom of Information Act, 45 Americans (and 15 Canadians) applied between 2004 and 2008. I find that so interesting. Were things THAT bad back home for people? You think, like the UK, America is a place to find safety, not run from it.  I know the whole lefty versus righty thing can get heated, but to the point to move to country? Why not apply for asylum in Canada?

It seems, strange. They author cited one case of a person from Texas and his outline of WHY he should be granted Asylum seekers status. I guess there are places in Texas that can be overwhelming and not willing to at least listen to another beliefs, but  you can move to other places inside of the United States thats more in line with your own views. Thats what so great about America. No need to change countries, just change states or even counties.

The only bit about the article that bothered me was this statement:

Does she not know how HARD it is to apply and receive a work visa in the UK? Even during the good times, it is incredibly difficult for an American (or non-eu citizen) to be receive a UK work permit.  Now a days with the Governments further restrictions on foreign workers, with the point system and EU residents having priority over jobs, its impossible.  Well it is, UNLESS you’re  someone of an extremely skilled nature and unique in your field, you will be guaranteed that Tier 2 visa.

I think what makes Ms Schusters statement so hard to handle, as she is a ‘expert’   she should have knowledge of that fact and how difficult it is to gain entry into the UK with valid right to remain. I bet there are loads of asylum seekers who have tried to apply for a Tier 2 visa and didn’t qualify. The only way to get their families to safety was to go down the Asylum route.

I think that statement, for me, is what makes this whole article so shocking and not so, ‘Oh I wasn’t the only one with the sorta-clever idea’

Great post on his forums about scalping REALLY works from the artists POV

As we approach on-sale dates for the upcoming tour, I’ve noticed lots of you are curious / concerned / outraged at the plethora of tickets that somehow appear on all these reseller sites at inflated prices – even before the pre-sale dates. I’ll do my best to explain the situation as I see it, as well as clarify my organization’s stance in the matter.

NIN decides to tour this summer. We arrive at the conclusion outdoor amphitheaters are the right venue for this outing, for a variety of reasons we’ve throughly considered*. In the past, NIN would sell the shows in each market to local promoters, who then “buy” the show from us to sell to you. Live Nation happens to own all the amphitheaters and bought most of the local promoters – so if you want to play those venues, you’re being promoted by Live Nation. Live Nation has had an exclusive deal with TicketMaster that has just expired, so Live Nation launched their own ticketing service. Most of the dates on this tour are through Live Nation, some are through TicketMaster – this is determined by the promoter (Live Nation), not us.

Now we get into the issue of secondary markets for tickets, which is the hot issue here. The ticketing marketplace for rock concerts shows a real lack of sophistication, meaning this: the true market value of some tickets for some concerts is much higher than what the act wants to be perceived as charging. For example, there are some people who would be willing to pay $1,000 and up to be in the best seats for various shows, but MOST acts in the rock / pop world don’t want to come off as greedy pricks asking that much, even though the market says its value is that high. The acts know this, the venue knows this, the promoters know this, the ticketing company knows this and the scalpers really know this. So…

The venue, the promoter, the ticketing agency and often the artist camp (artist, management and agent) take tickets from the pool of available seats and feed them directly to the re-seller (which from this point on will be referred to by their true name: SCALPER). I am not saying every one of the above entities all do this, nor am I saying they do it for all shows but this is a very common practice that happens more often than not. There is money to be made and they feel they should participate in it. There are a number of scams they employ to pull this off which is beyond the scope of this note.

StubHub.com is an example of a re-seller / scalper. So is TicketsNow.com.

Here’s the rub: TicketMaster has essentially been a monopoly for many years – certainly up until Live Nation’s exclusive deal ran out. They could have (and can right now) stop the secondary market dead in its tracks by doing the following: limit the amount of sales per customer, print names on the tickets and require ID / ticket matches at the venue. We know this works because we do it for our pre-sales. Why don’t THEY do it? It’s obvious – they make a lot of money fueling the secondary market. TicketMaster even bought a re-seller site and often bounces you over to that site to buy tickets (TicketsNow.com)!

NIN gets 10% of the available seats for our own pre-sale. We won a tough (and I mean TOUGH) battle to get the best seats. We require you to sign up at our site (for free) to get tickets. We limit the amount you can buy, we print your name on the tickets and we have our own person let you in a separate entrance where we check your ID to match the ticket. We charge you a surcharge that has been less than TicketMaster’s or Live Nation’s in all cases so far to pay for the costs of doing this – it’s not a profit center for us. We have essentially stopped scalping by doing these things – because we want true fans to be able to get great seats and not get ripped off by these parasites.

I assure you nobody in the NIN camp supplies or supports the practice of supplying tickets to these re-sellers because it’s not something we morally feel is the right thing to do. We are leaving money on the table here but it’s not always about money.
Being completely honest, it IS something I’ve had to consider. If people are willing to pay a lot of money to sit up front AND ARE GOING TO ANYWAY thanks to the rigged system, why let that money go into the hands of the scalpers? I’m the one busting my ass up there every night. The conclusion really came down to it not feeling like the right thing to do – simple as that.

My guess as to what will eventually happen if / when Live Nation and TicketMaster merges is that they’ll move to an auction or market-based pricing scheme – which will simply mean it will cost a lot more to get a good seat for a hot show. They will simply BECOME the scalper, eliminating them from the mix.

Nothing’s going to change until the ticketing entity gets serious about stopping the problem – which of course they don’t see as a problem. The ultimate way to hurt scalpers is to not support them. Leave them holding the merchandise. If this subject interests you, check out the following links. I agree with him. You need to choose your battles and how you fight them. I give credit to Pearl Jams efforts over 15 years ago (was it really that long ago?) but how long did it keep them off the road only to play venues and sell tickets through ticketmaster venues a few years later?

Loads of bands use pre-sale with the customers names printed on the tickets. I remember buying warehouse tickets and being paranoid I didnt have my card with me for the May 2002 MSG shows.  My name was printed on the ticket, along with my membership id. I remember when WH tickets on eBay going for disgusting amounts, the wh threatened with cancelled memberships (which they did make good on) and banning. (Though that only worked until the person moved house again, which happened often as most of DMB fans are in college and move a lot in 4 years time) It did help cut back on a lot of the ‘bad’ fans making money off those who just wanted to go. Though they werent very scary rules, they were enough to keep most people in line. Ticketmaster can easily do this. Understandable 10 years ago when buying tickets online just wasnt common place and people had to camp outside their favourite hidden TM outlet, but now with most ordered via the web or online printing the name on the ticket is VERY easy.

I still dont get paying over $1000 for ONE ticket to a concert? The most Ive paid (well via  a scalper – and actually the only time Ive bought scalped tickets) was €150 for 2 Ryan Adams tickets for when he was in Dublin in 2006. I mean it was a stretch to pay £50 for my NK ticket, then the addition £118 for the upgrade (but worth it to meet the guys on THEIR terms) But even still, with all this its making concert going only being available to those who have the money or willing to go bankrupt to see an act in concert. Whose to say those in the middle – you know the middle/working class – arent as big of a fan as the stockbroker or the VP on some big company? They, too, have the right to see a show and enjoy themselves as much as the next guy without having to sit in the obstructed view area or nosebleeds to do so.

Like Trent said above, they dont care :( TicktBastard want their money and thats all that matters. Big time stars cant even rebel against it because it means either making tour stops in really random venues that arent up to par OR taking a hiatus completley, which still isnt fair. Worse, being blacklisted until they give in. Its only going to get scarier and not better.

I mean we have artists like the Eagles, the Stones, Fleetwood Mac, Paul McCartney and more acts of our parents (well if your parent was born after WWII and BEFORE Vietnam started) generation charging stupid amount, bands wouldnt think they could get away with it.  I remember when I went to see the Depeche Mode in 1994 and thinking $25 was a lot. Now thats ‘cheap’.  Sad, really.

There needs to be more control and restrictions in place to protect the BUYER. If they put the prices through the roof, then live entertainment is going to see the same troubles that the recording industry is currently going through. Waiting too long to embrace change in their practices and policies they are now struggling to catch up with what the masses have embraced as the alternative. I mean I dont know how else bands will do it (free shows at random spots?!) without ripping off fans? there has to be a decent middle ground, right?

One can only hope and wait it out.. Hopefully other artists follow nins lead (well, alongside the String Cheese Incident and No Doubt) take the proactive vocal way to take on ticketmaster. Maybe there is hope out there. Maybe.

ive been helping out with the parking situattion at work – even though i dont drive – because people would moan about it and then not do anything. i hate that, why whinge and then do nothing about it? anyways, i took it on so people would stop ‘passing the buck’ in a way.  all it cost me was using a connection or two i had at work to talk to a local councilman and a few hours of emailing my floor – not even the whole building – to put a small plan in place. all i gathered was a little bit of data (< 50 or so people responded to my intial email), put it in a spreadsheet and passed it along when the parking scheme went under review in late September.

nothings been set in place yet, but the council, theyre actually LISTENING and taking on board all the information i gathered to help put a plan in place. In fact the plan theyve almost agreed to is the one i came up with just looking at the situation from being on the outside.  its weird, because the council asked why no one has brought the issue to anyones attention until now – when the scheme was under review – and not before it was put into place in Oct 2007. apparently no one objected at the hearings held nor was the issue discussed at work. its great this is actually happening because people always moan that councils dont listen to their residents. well apparently this one is listening to me.

anyways, it feels good doing something to help make my town a better place to live and where i work a better place to be. its just a shame it took this long to sort it out, when it really didnt take THAT much effort in the first place. i jut wish i could say EXACTLY what was happening, but cant until meetings take place in late January. ahhhhhhh

Hillary Clinton plans to accept the job of secretary of state offered by Barack Obama, who is reaching out to former rivals to build a broad coalition administration, the Guardian has learned.

Obama’s advisers have begun looking into Bill Clinton’s foundation, which distributes millions of dollars to Africa to help with development, to ensure that there is no conflict of interest. But Democrats do not believe that the vetting is likely to be a problem.

Clinton would be well placed to become the country’s dominant voice in foreign affairs, replacing Condoleezza Rice. Since being elected senator for New York, she has specialised in foreign affairs and defence. Although she supported the war in Iraq, she and Obama basically agree on a withdrawal of American troops.

Clinton, who still harbours hopes of a future presidential run, had to weigh up whether she would be better placed by staying in the Senate, which offers a platform for life, or making the more uncertain career move to the secretary of state job.

As part of the coalition-building, Obama today also reached out to his defeated Republican rival, John McCain, to discuss how they could work together to roll back some of the most controversial policies of the Bush years. Putting aside the bitter words thrown about with abandon by both sides during the election campaign, McCain flew to meet Obama at his headquarters in the Kluczynski Federal Building, in downtown Chicago.

Obama, speaking before the meeting, said: “We’re going to have a good conversation about how we can do some work together to fix up the country.” He said he also wanted to thank McCain for his service to the country.

Asked by a reporter whether he would work with Obama, McCain, who has long favoured a bipartisan approach to politics, replied: “Obviously”.

Sources on both sides said Obama did not offer McCain a cabinet job, but focused on how the senator for Arizona could help to guide through Congress legislation that they both strongly favour.

Given Obama’s status as president-in-waiting, the two met in a formal setting, a room decked out with a US flag, and were accompanied by senior advisers. Obama appeared the more relaxed of the two, sitting with legs crossed, smiling broadly and waving to reporters, while McCain sat stiffly, with a seemingly fixed grin.

Although the two clashed during the election campaign over tax policy and withdrawal from Iraq, they have more in common than they have differences. They both favour the closure of the Guantánamo Bay detention centre, an increase in US troops to Afghanistan, immigration reform, stem cell research and measures to tackle climate change, and oppose torture and the widespread use of wire-tapping.

Although Democrats made gains in the Senate in the November 4 elections, they fell short of the 60 seats that would have allowed them to override Republican blocking tactics and will need Republican allies to get Obama’s plans through. This was highlighted today when the Democratic leadership in Congress announced that a broad economic stimulus package Obama sought was not likely to be passed because of Republican opposition.

Obama confirmed at the weekend that he would offer jobs to some Republicans. One of the names that crops up most often is Chuck Hagel, the former Republican senator who is a specialist in foreign affairs and a critic of the Iraq war.

Tuesday night was a BIG night, regardless of whose side you were on. I was excited, nervous of 2004 showing (Kerrys won! Oh wait, no he hasnt….) and a repeat of the 2000 (is a pregnant chad a full vote? does it count?) and how would i continue to explain what would happen that night for the next 4 years. its been more than frustrating explaining bush and the over zealous religious right and their 8 year rule. explaining how im not like them and theres more like me out there.

I stayed up watching cnn and their holograms (Mike and I had to rewind the live tv because we werent believing just exactly what we were seeing) until 3.30am GST and seeing their coverage pretty much show unless McCain won California, he was screwed. I went to bed hoping for the best but expecting the worst. I was VERY happy when I found out that the Democrats did it, despite the mess they all made of the race this year. I was proud to hear people waiting out for hours before the polls opened to make their voices heard. I was actually jealous of not being able to stand outside West Babylon Public Schools administration office to make my vote as I had done since May 1995.

Im hoping Mr President Elect can keep most of his promises. I hope hes not some flash in the pan. I hope he makes Teddy Kennedy proud of backing him. I hope he can withdraw us peacefully from this war. I hope he can improve the Economic state without hurting too many people. I hope he can join both parties in both houses to work side by side instead of against one another (you hear me Pelosi??) with not too many problems. I hope he can provide the poor and the working class with medical benefits. I hope he can ease socialism back into the US without it being a dirty word. I hope he learns from the UK, France and Canadas mistakes.  Mostly I hope he doesnt disappoint everyone who believes so strongly in him (I remember the first time Clinton disappointed me, I was heartbroken) and they can easily forgive when he does.

I am very excited about the next 4 years. I am excited about January 20th 2009. I am hoping we will all be still saying ‘Yes We Can’ in 4 years time. Congratulations Mr Barack Obama , you deserve it.

posted off my absetee ballot tonight as we’re leaving to go to tenerife tomorrow morning at 6am and im not going to be back here in time to post it off closer to the election. if theres a close count in babylon town, my vote will count, damnit!

listened to the new ryan adams and i like it, but im also a fanboy (fangirl??) so i dont know what that says about me. it a little all over the place, lyrically and style, but the cardinals sound VERY tight and ryan is just lost in outer space.  there apparently a book being released, i dont think im getting it.

hmm i randomly saw that the hold steady are coming back to sheffield and the leadmill. maybe theyll play the larger room this time and not given the boot for the lame school disco they hold. heh. abc and the human league are touring as well in decemeber.. ill probably go to both. ive never seen the human league perform so hopefully it be good considering theyll be in their home town (they all still live here…)

anyways i think this will be the last post until we get back on the 31st, though if things get crazy ill probably sneak off to an internet cafe and blog out my brains. or at least play around on facebook. heh.

damnit ive just discovered ive lost my photos from when i saw the hold steady in feb 2007. gaaaaaaaaaah.  they have to be somewhere… probably on mikes computer. grr.
